Patent Type:
1: Invention: This shall have legal effect from the date of publication and shall expire 20 years after the filing date of the application.
2: Model: This shall have legal effect from the date of publication and shall expire 10 years after the filing date of the application.
3: Design: This shall have legal effect from the date of publication and shall expire 12 years after the filing date of the application.
Required Documents
• Specification, claims, abstract and drawings on A4 paper (29.7cm x 21 cm).
• Full details of the inventor (name, address, nationality) .
• Full details of the applicant (name, address, nationality), if the applicant is a company, the legal representative's name is also required .
• One set of power of attorney (POA) form which is duly signed by the applicant company's representative (no notarization/legalization is required).
• One set of assignment signed by the inventor if the applicant is not the inventor.
• If convention priority is claimed, priorities date country, application no. and a
certified copy of priority documents.
Examine Procedure
• Invention: After filing, the first office action will generally take place within 15-18 from the filling date . If we receive the allowance notice for the patent , we must pay the issue fee within three months. Once the patent issue fee is paid, the application is proceeded to publish .
• Utility Model: After filing, the first office action will generally take place within 6-8 from the filling date . If we receive the allowance notice for the patent , we must pay the issue fee within three months. Once the patent issue fee is paid, the application is proceeded to publish .
• Design: After filing, the first office action will generally take place within12-14 from the filling date . If we receive the allowance notice for the patent , we must pay the issue fee within three months. Once the patent issue fee is paid, the application is proceeded to publish .

• Patent Publication: 18 months from the priority date
• Formal Examination Request: Before 36 months from the filing date. Must be • requested after 60 days from the patent publication date.
• 90 days to respond office action from the formal examination.
• Acceptance or rejection
• Payment of the Final Taxes and Title.
Validity of patent
Concession of the Patent Grant: 20 years
Concession of the Utility Model or Design Application: 15 years
Patent Priority
All the member states of WTO can claim patent priority in Taiwan, except People's Republic of China. Please note that for Invention and UtilityModel , applications must be filed within one year from the first filing date; for New Design, applications must be filed within six months from the first filing date.
